Laporan Polisi Pertama

Saya mengakui laporan pertama pada kepolisian Bali tidak pintar. Saat itu saya belum mengerti kenapa saya kalah di sidang perceraian. Saya tidak tahu bahwa keterangan saksi-saksi Made Jati ternyata Keterangan Palsu, atau bahwa keterangan saksi-saksi saya dipalsukan dan dibalikan. Saya tidak tahu bahwa ternyata perbuatan Austrindo Law Office berhubungan dengan putusan kalah.

Pengacara saya, M. Rifan SH dari Austrindo Law Office mengajak saya ke Polda Bali dan menerjermahkan supaya bisa melapor perbuatan diduga Penipuan.

Saya kecewa beberapa minggu kemudian waktu Penyidik Wayan Karta mengatakan bahwa penyelidikan dihentikan karena semua saksi setuju ada perkawinan upacara Hindu Bali tahun 1996, maka tidak ada bukti pidana.

Tetapi saya kaget dan marah tiga bulan kemudian karena belajar dari pengacara-pengacra baru Maharidzal SH and Mangasi Simangunsong SH, bahwa saya belum melapor Penipuan sama sekali.

Rifan menyesatkan saya dengan menerjermahkan bahasa Ingris - Fraud - dengan mengatakan artinya bahasa Indonesia adalah "Pengelapan". Maka saya baru melapor Pengelapan, yang menurut hukum Indonesia mustahil antara suami istri. Saya merasa ditipu licik.

Laporan Polisi Kedua

Dengan pengacara baru Maharidzal and Mangasi Simangunsong, saya lapor lagi di Polda Bali, kali ini dengan istilah yang benar - Penipuan.

Maharidzal dan Mangasi Simangunsong merunding lebih dari empat jam sebelum merasa puas dengan pilihan penyidik yang bisa dipercaya tidak bias, dan akhirnya saya dikenalkan dengan Penyidik Hagnyono SH.

Hagnyono memeriksa dua puluh satu saksi serta foto-foto dan dokumen-dokumen, dan akhirnya Made Jati dipanggil sebagai tersangka. Dia mengakui bohongan upacara perkawinan Hindu Bali yang dia mengatakan dilangsungkan tahun 1996.

Berkas dilimpahkan pada Kejaksaan Tinggi, tetapi dari Kejaksaan ada pihak tanpa nama, hanya disebutkan "yang lantai dua," yang melawan. Kalau mendakwas seorang perempuan Bali karena menipu suaminya yang orang Amerika, kami diberitahu, bisa merusakan citra Bali. Berkas itu mulai bolak balik dengan surat P19 antara Polda dan Kejaksaan setiap empat belas hari, dengan pertanyaan Kejaksaan makin lama makin kabur, dan jawaban Polda Bali makin frustrasi.

Laporan Polisi Ketiga

Saat memeriksa dokumen-dokumen keluarga bulan Oktober 2006, saya menemui lagi perbuatan diduga Penipuan. Pada tahun 1992, Made Jati manfaatkan Surat Keterangan dari Tabanan yang menyatakan dia "Belum Kawin" dan domisili di Tabanan, untuk memindah Sertifikat Tanah yang sekarang Kori Restaurant sebagai Akte Hibah atas namanya.

Saya melapor pada Polres Tabanan, dan setelah beberapa bulan penyedikan, Made Jati dipanggil sebagai tersangka, dan dia lagi mengakui keterangan di dokumen-dokumen tanah tersebut adalah tidak benar.

The Bali Police

First Police Report

Rifan had assured me that we did not need to make a police report about the fraud, but he had also assured me that we were certain to win the court decision. I returned to his office the next day and insisted we make a report.

DRAFT: In theory there is no reason anyone can't walk into a police office and file a criminal complaint, but Rifan said it was not that easy, and he was right

DRAFT: After the Putusan PN, MPD pushed Rifan again to help report NMJ’s false document fraud to the police. MPD and Rifan met with investigator I Wayan Karta to report the fraud, but Rifan did almost all the talking, while MPD was kept busy by other police, and when the report was finished Rifan read it and said it was okay and that MPD should sign it. MPD read it and told Rifan that it was not accurate, but Rifan said ‘Don’t worry, we can fix it later,” so MPD signed it. I Wayan Karta met with NMJ and her witnesses, but he did not meet with MPD’s witnesses. On 23 January 2006 I Wayan Karta met with MPD at Rifan’s law office and reported that all witnesses had confirmed NMJ’s documents that the marriage had occurred 10 Juni 1994 in Tabanan and they had all been present, so there was no basis for a criminal complaint. This was ridiculous: NMJ’s accusation of divorce said the marriage had taken place in Kuta in September 1996, not Tabanan. I Wayan Karta reported that all witnesses agreed the ceremony took place in Tabanan, but I Wayan Karta never met MPD’s witnesses. (Per Law: this report LP/329/XI/2005/ Dit Reskrim Tanggal 28 Januari 2009 Tentang Tindak Pidana ended with SP2HP, never with SP3. So the Criminal Act was reported within nine months of the event, there is no problem with Statute of Limitations because the delay has been cause by the police themselves, and the report is still active.)

My first police report was admittedly naive. I didn't know then why I had lost the divorce trial, and didn't know that Made Jati's witnesses had committed apparent perjury, that the testimony of my witnesses had been falsified, or that Austrindo Law Office apparently had something to do with my loss.

My attorney M. Rifan SH of Austrindo Law Office accompanied me to the main police headquarters, Polda Bali, and translated for me as I reported suspected Fraud.

I was disappointed when the investigator Wayan Karta told me a few weeks later that they had dropped the investigation because all witnesses had confirmed a Balinese wedding had occurred in 1996 and therefore they found no evidence of a crime.

But I was astonished and angry three months later to learn from my new attorneys, Maharidzal SH and Mangasi Simangunsong SH, that I had never reported Fraud - Penipuan - at all.

Rifan had misled me in his translation. I had reported Pengelapan - or Embezzlement - which under Indonesian law is impossible between husband and wife.

Second Police Report

With my new attorneys Maharidzal and Mangasi Simangunsong, I reported again at Polda Bali, this time with the correct term for Fraud - Penipuan.

It took over four hours of negotiation before Maharidzal and Simangunsong were satisfied with the assignment of an investigator, Hagnyono SH, they felt we could trust.

Hagnyono examined twenty-one witnesses along with photographs and documents, and eventually Made Jati was called for examination as a suspect. She admitted that the Balinese marriage ceremony she claimed for 1996 had never occurred.

The file was sent to the Public Prosecutor, but there it ran into strong opposition from unnamed "people upstairs". Prosecuting a Balinese woman for fraud against her American husband, we were told, would be bad for the image of Bali. The case began to bounce back and forth between Polda Bali and the Prosecutor every fourteen days, with the Prosecutor asking for increasingly opaque clarifications, and Polda providing increasingly repetitive answers.

Third Police Report

Examining family documents in late 2006, I found another suspected fraud. In 1992 Made Jati had used a letter from Tabanan, certifying that she was a single woman living in Tabanan, to transfer the land title for what is now Kori Restaurant into her name.

I reported the documents to Polres Tabanan, and after several months of investigation, Polres Tabanan called Made Jati as a suspect and she again admitted that the statements in the documents were untrue.
